TERMS AND CONDITIONS OF SALE - EL COLIBRI LODGE

 

Any reservation made with El Colibri Lodge (hereinafter referred to as “the Lodge”), through the website www.elcolibrilodge.com or its Partners, implies full consultation, understanding, and unconditional acceptance of these Terms and Conditions.

For any other booking method, the Guest receives the Terms and Conditions together with the booking confirmation. Confirmation of the reservation implies acceptance of these Terms and Conditions and full and unconditional acceptance of their provisions.

No general or specific terms communicated by the Guest may be incorporated into these Terms and Conditions.

RESERVATION

All reservations are personal and may under no circumstances be transferred to a third party, whether free of charge or for compensation. Any reservation made on behalf of another person must be made in the name of the person staying at the Lodge.

RATES

The price of the stay includes the local tax applicable on the date of booking, and any change in the applicable local tax rate will automatically be reflected in the price indicated on the invoice date.

The price of the stay is confirmed to the Guest inclusive of all taxes, in the Lodge’s commercial currency (US Dollars). All reservations are payable in the Lodge’s commercial currency or in the Lodge’s local currency (Colones).

PAYMENT

Payment is due upon the Guest’s arrival at the Lodge in US Dollars or Colones. No advance deposit is required.

Payment by bank transfer may also be requested upon the Guest’s express request, with all bank charges borne by the Guest. The transfer of the total amount of the stay must be completed no later than one day before the Guest’s departure. In the absence of receipt of the transfer, the Guest shall make payment for the stay on site. The Lodge undertakes to reimburse any amount received twice, with bank charges remaining the responsibility of the Guest.

Payment may also be made via PayPal. The Guest agrees to bear the 5.4% PayPal transaction fees charged to the Lodge.

CANCELLATION POLICY

It is important that our Guests understand that once their reservation has been confirmed, any other booking request is refused in order to guarantee the availability of their stay.

Any cancellation must be communicated in writing. In the event of prepayment, reimbursement of the amount received shall be made as follows:
- The Guest may cancel the reservation free of charge up to 15 days before the arrival date.
- 50% of the amount paid, minus bank charges, will be refunded in the event of cancellation from 14 to 8 days before the arrival date.
- The amount paid will not be refunded in the event of cancellation within the 7 days preceding the arrival date.

Interruptions of stay due to weather conditions or any other reason, late arrivals (including flight delays or delays related to other means of transportation), and no-shows shall not give rise to any refund.

CANCELLATION BY THE LODGE

In the event that the reserved room cannot be made available to the Guest, or in the event of exceptional circumstances or force majeure (power outages, tropical weather conditions, wildlife-related events, local authorities), the Lodge will offer the Guest a full refund of the amount paid for the stay.

STAY AT THE LODGE

The Guest agrees and undertakes to use the room and the common areas made available to them in a reasonable manner.

The Lodge reserves the right to refuse admission or expel, without any refund being claimed, Guests whose behavior is inappropriate, aggressive, dangerous, heavily intoxicated, or contrary to hygiene standards, public order, the peace and quiet, or the safety of the establishment.

Children under 12 years old are not permitted.

For safety reasons and out of respect for everyone, smoking within the Lodge premises, using candles, and cooking inside the rooms are prohibited.

Pets are not allowed within the establishment.

It is prohibited to remove any room accessories outside the Lodge. In the event of loss or damage, the cost may be charged directly to the Guest.

If the Guest is accompanied by visitors, such visitors must present an identity document upon entering the Lodge. Minors are not permitted without their parents.

It is prohibited to organize parties within the establishment or engage in noisy behavior after 9:30 PM.

Given the natural environment surrounding the Lodge, the Lodge shall not be held responsible for incidents or accidents resulting from natural or weather-related events and interactions with wildlife.

Unless expressly agreed otherwise, the Guest must vacate the room before 11:00 AM on the day the reservation ends. Failing this, a charge of 10 USD will apply for each additional hour started.

Any damage caused by the Guest or by any person occupying the room and common areas during the stay must be reported to the Lodge and may be directly charged to the Guest according to the damage incurred or restoration costs.

PARKING

The Lodge provides free parking; however, it shall not be held responsible for damage caused to vehicles or for the loss of items left inside them.

LIABILITY

The Lodge has Internal Rules intended for Guests. The Guest accepts and undertakes to comply with said rules, the provisions of which apply both to the Guest and to any occupant accompanying them. In the event of a breach of said rules, the Lodge may immediately expel the Guest and all persons sharing the stay, without any refund being claimed.

The Lodge shall incur no liability, whether free of charge or for compensation, for any direct or indirect damage resulting from the actions of the Guest or of a third party, except in the event of gross negligence or intentional misconduct by the establishment.

The Lodge shall incur no liability for the disappearance of valuables left on the room terrace, inside vehicles, or in rooms left open or unlocked.

PERSONAL DATA

Personal information collected in connection with reservations is used exclusively for the management of the stay and the legal obligations of the establishment. Such information is never sold to third parties.
